LocalPestCall operates as a connection service that facilitates the matching of homeowners and property owners ("Users") seeking pest control services with vetted, third-party pest control service providers ("Service Providers") in their local area.
LOCALPESTCALL DOES NOT PERFORM PEST CONTROL SERVICES. LOCALPESTCALL IS NOT A PEST CONTROL COMPANY AND DOES NOT EMPLOY PEST CONTROL TECHNICIANS OR EXTERMINATORS.
Our Service involves collecting information about your pest control needs and your location, and then transmitting this information to one or more Service Providers in our network who may be able to fulfill your request. We do not charge Users for this connection service.
LocalPestCall performs an initial vetting process for Service Providers in its network, which may include verifying current licenses and insurance at the time of their inclusion in our network. However, LocalPestCall:

LOCALPESTCALL MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THEIR SERVICES, OR THE INFORMATION, CONTENT, OR MATERIALS INCLUDED THEREIN. YOU EXPRESSLY AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.
LOCALPESTCALL DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LOCALPESTCALL, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE, OR ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
You agree to defend, indemnify, and hold harmless LocalPestCall and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.
The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of LocalPestCall and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of LocalPestCall.
